General terms and conditions of sale
Article 1 - Purpose
These terms and conditions define the rights and obligations of the parties within the framework of remote booking of services offered by the Enjoy In agency, for the chosen accommodation(s), the details of which are specified in the booking confirmation document. They govern all the steps necessary for booking and managing the booking between the contracting parties. The client acknowledges having read and accepted these General Terms and Conditions of Sale and the terms and conditions of sale for the reserved rate, accessible on the website. These General Terms and Conditions of Sale apply to all bookings made by telephone and internet, directly or indirectly through online travel agencies (e.g., Booking.com).
Article 2 - Reservation
The customer selects the services presented on the booking platform. They acknowledge having reviewed the nature, purpose, and booking terms of the services available on the platform and having requested and obtained all necessary and/or additional information to make their booking with full knowledge of the facts. The customer is solely responsible for their choice of services and their suitability for their needs; therefore, we cannot be held liable in this regard. The booking is deemed accepted by the customer upon completion of the booking process.
Article 3 - Booking Process
Reservations made by the customer are made by telephone in direct exchange with the enjoy in agency or online (on the website www.booking.com).
The reservation is deemed to be formed upon receipt of written confirmation from the client, in the form of an email or a signed contract, of the reservation and its conditions.
The client agrees to ensure the veracity and attest to the accuracy of the information provided.
After the final selection of services to be booked, the booking procedure includes, in particular, consulting and accepting the general terms and conditions of sale and the terms and conditions of sale of the reserved rate sent by email before validating the booking and, finally, validating the booking by the customer.
Article 4 - Acknowledgement of reservation
The agency acknowledges receipt of the client's reservation by receiving without delay an email confirming acceptance of the general terms and conditions of sale and the terms and conditions of sale of the reserved rate, or by receiving a rental agreement signed by all parties.
The email or contract summarizes the rental offer, the services reserved, the prices, the sales conditions relating to the selected rate, accepted by the customer, the date of reservation made, the information relating to after-sales service, as well as the address of the reserved accommodation.
Article 5 - Booking Regulations

A deposit of 30% of the total all-inclusive amount is required once the booking process is complete and written confirmation is received from the client.

The balance of the stay must be paid before the 14th calendar day preceding the arrival date, at the client's initiative.

An invoice is provided to the client upon request and departure, detailing the services provided, the total cost and reservation details, the cost of any additional services, and the amount of tourist tax and other applicable taxes.
Article 6 - Payment
The client may provide the Enjoy In agency with their bank details as a guarantee of the reservation, except in specific conditions and at specific rates, by credit card (Visa, Mastercard) indicating the card number, its expiry date (it is specified that the bank card used must be valid at the time of service), and the security code. The 30% deposit is debited upon booking, and the remaining balance is debited 13 calendar days before the arrival date.
The customer can also pay directly by bank transfer, upon request; a bank account number will be provided accordingly.
In case of no show (reservation not cancelled – client not present) after this 13th calendar day and the arrival date, no refund will be made except in cases of force majeure validated by the agency enjoy in.
Article 7 - Force majeure
Force majeure is defined as any event beyond the control of the parties that is both unforeseeable and insurmountable, preventing either the client or the establishment from fulfilling all or part of their contractual obligations. Events of force majeure or fortuitous events are those typically recognized by French courts and tribunals.
Neither party shall be liable to the other for any failure to perform its obligations resulting from a force majeure event. It is expressly agreed that force majeure shall suspend the performance of the parties' reciprocal obligations and that each party shall bear its own costs arising therefrom.
Article 8 - Cancellation or modification by the customer
Any modification of the reservation, date, accommodation, is only possible after agreement from the agency enjoy in and may possibly incur additional charges, and will be made according to availability on the date of the modification.
The client is informed of the specific conditions in case of cancellation of the reservation before the start of the stay:

If the cancellation occurs more than 14 calendar days before the arrival date, the deposit paid at the time of booking will be fully refunded to the client;

If the cancellation occurs between the 14th calendar day and the arrival date, the entire amount of the reservation will remain due to the agency enjoy in, i.e. the deposit paid at the time of booking and the balance of the total amount of the reservation, will remain acquired by the agency enjoy in.

In case of early departure during the stay, the full amount of the reserved service will be due.

All reservations are nominative and cannot under any circumstances be transferred to a third party, whether free of charge or for payment.
Article 9 - Cancellation of stay by the owner
If, before the start of the stay, the agency enjoy in has to cancel the reservation, it will immediately inform the client by registered letter with acknowledgment of receipt.
The customer will then be immediately and fully reimbursed for all sums paid.
Article 10 - Consumption of the service
In accordance with regulations in certain countries, guests may be asked to complete a police registration form upon arrival. To do so, guests will be asked to present identification to verify whether or not they are required to complete the form. Parties and noisy events that disturb the neighborhood are prohibited.
Any behavior contrary to good morals and public order will lead the agency enjoy in to ask the client to leave the reserved accommodation immediately, without any compensation and/or without any refund if payment has already been made.
Furthermore, the use of prohibited websites or websites with content prohibited by French law is strictly forbidden.
The client will be solely responsible for their actions during the reserved period.
Any damage will be subject to compensation commensurate with the extent of the damage caused, both to the property and its equipment. A reasonable and consistent sum, determined by the Enjoy In agency, will be invoiced to the client.
Article 11 - Dispute Resolution
These General Terms and Conditions of Sale are governed by the law of the country of establishment without prejudice to any mandatory protective provisions that may be applicable in the country of residence of the consumers.
Article 12 - Length of stay
The client who has reserved accommodation with the agency enjoy in, for a fixed period, may not under any circumstances claim any right to remain on the premises.
Generally, the minimum booking period is 2 nights for:

Maison Elise, Logis Robin, Logis Lina and Villa Jules Petit gîte;
and the minimum booking period is 3 nights for:

Villa Jules, a large gîte.
These minimum durations may vary upwards in certain cases, particularly for long weekends and the peak season (July and August).
For Villa Jules Grand gîte, bookings are from Saturday to Saturday in peak season.
The maximum duration for a reservation is 29 days.
Article 13 - Arrival and Departure Times
The client must arrive on the date specified in their booking, from 4:00 PM onwards (when the accommodations are available). Each accommodation has its own key box; the location and code will be provided on the client's arrival day.
The client must notify us by telephone if, due to unforeseen circumstances, they are forced to arrive after the date specified in the reservation. Whenever possible, arrivals should not be scheduled after 10:00 PM.
The departure time for the accommodations is set at 10:00 at the latest.
Limitation of Liability Clause
Pets are not allowed in the accommodations, with the exception of the Villa Jules Petit gîte, upon request only. A limit of 2 pets will be imposed.
The client agrees to maintain the cleanliness of the accommodation (floors, furniture) and the exterior areas, including picking up animal waste. They also agree to minimize any potential noise disturbances.
Any damage will be subject to compensation up to the amount of the damage caused.
Article 15 - Lifestyle and use of premises
In order to preserve the tranquility of the premises and the comfort of all, everyone is asked to respect certain rules:

Smoking is not permitted inside the accommodations.

For safety reasons, it is strictly forbidden to use open flames such as matches, candles, tapers, Bengal lights, etc., and open flame lighting devices, candelabras, tapers, light fixtures in dwellings.

Open flame lighting devices, candelabras, candles, light fixtures, are permitted only in outdoor areas, at a reasonable distance from the dwelling, and must be kept away from any flammable material; in addition, they must be arranged so that, even in the event of an accidental fall, they cannot be a cause of fire.

The client agrees to return the accommodations in perfect condition at the end of the stay and to systematically report – and financially assume – any damage for which they are responsible.

Guests are reminded that minors are the sole and full responsibility of their parents or guardians. This is especially true at Villa Jules Grand Gîte and its swimming pool, which requires strict adherence to usage and safety instructions, under the sole and complete responsibility of the parents or guardians of minors.

For adjoining accommodations such as Villa Jules Grand gîte and Petit gîte, it is requested that noise emissions be limited in general and in particular that running, jumping, shouting be avoided on the upper floor due to a shared oak floor between the two accommodations.
Article 16 - Price
Prices are offered directly by Laetitia and Stéphane of Enjoy In Agency. These are the best available rates at the time for the client.
Prices are per accommodation and do not depend on the number of people present during the stay.
The year is divided into seven seasons, with rates increasing progressively from the low season to the high season.
Discounts are offered, outside of the high and high seasons, for weekly bookings (minimum 7 nights) and monthly bookings (minimum 29 nights).
Promotional periods are also available.
Prices for booking services are indicated before and during the booking process. Prices are confirmed to the client inclusive of all taxes, in the establishment's local currency, and are valid for seven days only.
All bookings, regardless of origin, are payable in the establishment's local currency, unless otherwise specified on site. Unless otherwise stated on the booking, additional services are not included in the price. Any applicable taxes (local taxes, tourist taxes, etc.), shown on the rates page, are payable directly to the establishment upon arrival. Prices include VAT at the rate applicable on the date of booking, and any change in the applicable VAT rate will be automatically reflected in the prices shown on the invoice date.
Any modification or introduction of new legal or regulatory taxes imposed by the relevant authorities will be automatically reflected in the prices shown on the invoice date.
Article 17 - Modification of the terms of sale
These Terms and Conditions of Sale are subject to change at any time without notice.
Acceptance of and compliance with these Terms and Conditions of Sale are deemed to have been given upon payment of the deposit.
Article 18 – Data Protection Act
In accordance with French law no. 78-17 of 6 January 1978 concerning information technology, data files and civil liberties, the customer has the right to access and rectify their personal data. The owner undertakes not to transmit the information provided by the customer to any other companies or organizations for advertising purposes.
Article 19 - Liability
The photographs displayed on the website are not contractual. While every effort is made to ensure that the photographs, graphic representations, and texts used to illustrate the properties presented provide as accurate a representation as possible of the services offered, variations may occur between the time of booking and the day the service is used.
Enjoy In agency cannot be held liable for the non-execution or improper execution of the booking in the event of force majeure caused by the client or a tenant, including but not limited to internet network unavailability, inability to access the website, external intrusion, viruses, etc.
Any booking or payment that is irregular, invalid, incomplete, or fraudulent for a reason attributable to the client will result in the cancellation of the order at the client's expense, without prejudice to any civil or criminal action against the client.
Article 20 - Complaints
Claims relating to the non-performance or poor performance of the services booked must, under penalty of forfeiture, be brought to our attention in writing within seven days after the date of departure from the establishment.
